Legal and Judicial Solutions

Court technology is the next emerging market...

Throughout the past 20 years, great strides have been made nationally to move toward technology solutions in the federal, state, and local court systems. Many proprietary systems have been developed and silos created amongst the government agencies with oversight over the court system. Only 10% of courts nationally are utilizing digital court reporting solutions, to date. Approximately 4% of courts use a web based calendaring system and less then 1% of those are interactive. Video arraignment is prevalent in courts but many metropolitan areas still have not integrated the solution and none are actively using video as the official court record as of yet.

Calendaring and E-filing

By adding an online court calendaring system, a court can realize a 60% to 90% reduction in the amount of resources required for calendaring schedule management. Online court calendaring offsets the responsibility of data entry to an attorney or law firm. The legal community will also realize a 30% - 50% reduction in the amount of time spent calendaring.
An attorney using a ‘pay as you go’ e-filing solution can expect a 40% - 60% reduction in filing cost just from mail, private carrier and courier services. An attorney utilizing a onetime subscription solution for e-filing can expect a 90% - 120% reduction in cost from traditional delivery methods. This overall reduces the cost of court.
“More than half of the carriers who write legal malpractice policies give 5 to 25 percent discounts to lawyers and law firms that use computerized systems to schedule their calendars.” - Howard Yellen, J.D. “Legal Malpractice: Risk Reduction that Makes Sense”

A recent American Bar Association (ABA) study, Profile of Malpractice Claims, identifies court calendar-related errors as the leading cause of legal administrative malpractice claims.
– 23 percent of legal malpractice claims were due to not knowing or not properly responding to the legislated court rules dates
– 15.24 percent due to failure to know/ascertain calendar

– 7.03 percent due to a failure to calendar
– 1.27 percent due to failure to react to calendar.

Integration is the Solution

The problem remains that there are no completely integrated solutions. Each area of need is addressed individually by companies and not as an integrated solution. Court systems are strapped with an increasing cost burden without any real strategies to cut cost and improve the system. Most courts operate functionally as they did 50 years ago and have not responded to the increase in workload effectively. By integrating the varying court operations systems and moving to an automated court technology plan we are able to reduce cost and increase efficiency. By eliminating duplicate keystrokes alone most court systems can expect a 20%-30% reduction in labor cost. Integration must include the attorneys who work in the court. Most models to date only consider the workflow of the court not the workflow of the users of the court.

Softworks’ concept is to provide integrated solutions to the justice systems that create cost savings for the court and allow it better realize and utilize existing technologies and funds.
Softworks’ offers integrated models with built in revenue streams. These solutions allow the court to move the cost burden of technological advancement to attorneys and other stakeholders who utilize the services of the court. In addition, levying fees to stakeholders allows the court to generate funds for future advancement. Ultimately leading to an overall reduction in cost from savings created by technological advancement and more capital for improvements. Charging stakeholders subscription fees allows for recurring revenue generation.
